Within days of slimming down his final legal defense team, President Donald Trump’s lawyers have now prepared his official answer to the ridiculous articles of impeachment against him in the Senate. And, he remains defiant.
We previously reported that President Trump had announced his lead attorneys for his impeachment trial in the Senate, set to take place this month.
Now, that team has prepared a document containing its legal answers to the numerous frivolous allegations contained within the articles of impeachment put forth by mostly Democrats.
In the document, Trump defiantly answers the eight allegations he believes were asked in the articles of impeachment. At no point in the document does he let up or show signs that he plans to back down.
A major argument of the eight legal retorts is its unconstitutional illegitimacy. The Senate does not have jurisdiction to impeach a private citizen, which Donald Trump now is since January 20th, since he is no longer president. In fact the closing statement of the signed document is as follows:
WHEREFORE, Donald John Trump, 45th President of the United States
respectfully requests the Honorable Members of the Senate of the United States
dismiss Article I: Incitement of Insurrection against him as moot, and thus in
violation of the Constitution, because the Senate lacks jurisdiction to remove
from office a man who does not hold office. In the alternative, the 45th
President respectfully requests the Senate acquit him on the merits of the
allegations raised in the article of impeachment.”
He also rightly highlighted the illegitimacy of having the Senate have a rabid anti-Trump partisan Senator preside over the proceedings because even anti-Trump SCOTUS Chief Justice Roberts has refused to be a part of this sham impeachment trial.
Another salient point he makes is that an article of impeachment may not be used as a catch all and also deprive him of due process; it is what they call an indivisible document, meaning that it can only contain one alleged crime. Because the current articles of impeachment list several, it is illegitimate and frivolous as a “by-product of the haste in which the House unnecessarily acted while depriving the 45th president of the United States of his American right to due process of law. Therefor, it would be necessary for members of the senate to find President Trump guilty of all the allegations within the articles, or none of them, since the document is supposed to be indivisible.
President Trump also says that some allegations are merely condemnations of free political speech that everyone has according to the Constitution of the United States.
